CSG Law Alert: Important Upcoming Deadlines: Integrity Fee & I-956G Compliance
As we approach the end of September, we want to remind you of two crucial deadlines that every active EB-5 regional center should keep in mind.
One week left before Integrity Fee payment month starts!
The annual Integrity Fee payment deadline is just around the corner! According to the EB-5 Reform and Integrity Act of 2022 (“RIA”), every active EB-5 regional center is required to pay an annual Integrity Fee:
- $10,000 for regional centers with 20 or fewer investors.
- $20,000 for regional centers with 21 or more investors.
Payment Window: The fee is due between October 1 and October 30 each year.
Advance Payment: The fee paid in October 2024 will cover FY 2025.
Investor Count: USCIS counts any investor who has filed an I-526 or I-526E petition but has not yet filed an I-829 petition.
The RIA authorizes a late fee for payments made after October 30 and before December 29. USCIS interprets the RIA to require it to terminate any regional center that has not made the payment, or paid the correct amount, by December 29.
Please ensure that your payments are submitted on time to avoid any penalties!
I-956G season is here!
Additionally, the annual I-956G compliance filing for FY 2024 is now on the horizon!
Filing Period: Begins on October 1, 2024, and must be completed by December 28, 2024.
The new I-956G form requires significantly more data than the previous I-924A form, making accurate completion essential. USCIS may impose fines for inaccurate reporting, so it’s vital to start preparing your filings as early as possible.
